Auction Terms and Conditions
ONLINE AUCTION TERMS AND CONDITIONS
Pelienmaa
Effective from: [02.09.2026]
1. General Provisions
- These Terms and Conditions govern participation in online auctions organised by Pelienmaa through its online store.
- Auctions are available exclusively to users who have an active account in the Pelienmaa online store.
- By participating in an auction, the user accepts these Terms and Conditions.
- Users are required to participate in auctions in accordance with applicable laws and these Terms and Conditions.
- Pelienmaa reserves the right to refuse participation in an auction or restrict access to auctions in the event of a violation of these Terms and Conditions.
2. User Account
- In order to participate in an auction, the user must have a registered and active account in the Pelienmaa online store.
- The user is responsible for the accuracy of the information provided during registration and for the security of their account.
- Users may not use another person’s account or allow third parties to use their account for the purpose of placing bids.
- Pelienmaa may suspend or block a user’s account in the event of a violation of these Terms and Conditions, auction manipulation or other abuse.
3. Auction Items
- Auction items may include products offered by Pelienmaa, in particular trading cards, collectible products and other goods available in the store.
- Each auction includes real photographs of the actual item being offered. The photographs show the specific item that is the subject of the auction.
- Depending on the type and value of the item, an auction may include an additional product description. However, an additional description is not required for every auction item.
- Users should carefully review the photographs of the item before placing a bid. If an additional description is provided, the user should also review its contents.
- In the case of used, opened or visibly worn products, their actual condition is presented in the photographs included in the auction. Material information that cannot be adequately assessed from the photographs may additionally be stated in the auction description.
4. Placing Bids
- Users may place bids by selecting an amount in accordance with the current auction rules.
- Placing a bid constitutes a declaration of intent to purchase the item at the final auction price, subject to the consumer’s statutory rights.
- Users should ensure that they have selected the correct amount before confirming a bid.
- Users are responsible for bids placed using their account.
- Placing bids for the purpose of artificially increasing the price, manipulating the auction or harming other users is prohibited.
- Pelienmaa may cancel a bid or restrict a user’s participation in an auction where there are reasonable grounds to suspect manipulation or a violation of these Terms and Conditions.
5. Auction Process
- The current auction price is displayed on the relevant auction page.
- Each subsequent bid must meet the minimum bid increment specified by the auction system.
- Users may place bids until the auction ends.
- The highest valid bid registered by the auction system is considered the current highest bid.
- If a bid is placed within the final 2 minutes before the scheduled end of the auction, the auction will automatically be extended by an additional 2 minutes.
- This extension rule also applies after an auction has already been extended. This means that each subsequent bid placed within the final 2 minutes of the current auction time will extend the auction by another 2 minutes.
- The auction may be extended repeatedly until no new bid is placed during the final 2 minutes.
- In the event of technical problems, Pelienmaa may take measures necessary to ensure the proper operation of the auction, including cancelling the auction, extending its duration or restarting it where justified.
6. End of the Auction
- The auction ends on the date and at the time displayed on the auction page, subject to the automatic extension rules described in Section 5.
- The user whose valid bid is the highest at the final end of the auction is the winner.
- After the auction ends, the winner will be notified by email or through their user account.
- The subsequent purchase, payment and delivery process is governed by these Terms and Conditions and the applicable rules of the Pelienmaa online store.
7. Payment and Non-Payment
- The auction winner must make payment within 48 hours of the end of the auction, unless a different deadline is stated on the auction page or in individual communication.
- If payment is not made within the initial 48-hour period, Pelienmaa will contact the user by email and remind them to complete the payment.
- Following the reminder, the user will have an additional 48 hours to make the payment.
- If payment is not received within the additional 48-hour period, Pelienmaa has the right to cancel the order associated with the winning auction.
- An order cancelled due to non-payment may result in the item being offered for auction again.
- If the same user fails to pay for two won auctions, the user will no longer be permitted to participate in future auctions organised by Pelienmaa.
- Restrictions on auction participation may also be applied in cases of other justified payment-related abuse or auction-related misconduct.
- Nothing in this section limits any statutory rights of consumers under applicable law.
8. Right of Withdrawal
- If the purchaser is a consumer who has a statutory right to withdraw from a distance contract, the consumer may exercise this right in accordance with applicable law.
- In the case of online sales of goods, the standard withdrawal period is generally 14 days from receipt of the goods.
- To exercise the right of withdrawal, the consumer must inform Pelienmaa of their decision within the applicable period.
- Detailed rules concerning withdrawal, returns and return costs are set out in the store’s general terms and conditions and applicable law.
- The right of withdrawal does not affect the consumer’s statutory rights concerning complaints and the seller’s liability for defective goods.
9. Delivery
- Items won at auction will be shipped to the address provided by the user in accordance with the delivery terms applicable in the Pelienmaa online store.
- Delivery costs are shown during the order process or in the information provided for the relevant auction.
- Pelienmaa makes reasonable efforts to dispatch orders as soon as reasonably possible after payment has been received.
- In the event of delays caused by external postal or courier services, applicable consumer protection laws shall apply.
10. Cancellation of an Auction by Pelienmaa
-
Pelienmaa may cancel an auction before it ends, in particular in the event of:
- a technical error,
- an incorrect product description or price,
- damage to or loss of the item,
- circumstances preventing the sale from being completed,
- suspected manipulation of the auction.
- If an auction is cancelled for reasons attributable to Pelienmaa, the user will not be required to pay for the cancelled auction.
- If payment has already been made, Pelienmaa will refund the amount received in accordance with applicable law.
11. Abuse and Auction Manipulation
-
The following activities are prohibited in particular:
- using multiple accounts to manipulate the price,
- placing bids on one’s own products through other accounts,
- deliberately increasing the price without intending to purchase,
- exploiting technical errors in the auction system,
- taking actions intended to disrupt the operation of the auction,
- attempting to circumvent restrictions imposed by Pelienmaa.
- If such activity is detected, Pelienmaa may cancel suspicious bids, block the user’s account and restrict or prevent participation in future auctions.
12. Technical Problems
- Pelienmaa makes reasonable efforts to ensure the proper operation of the auction system.
- In the event of a technical failure, system error or other issue affecting the proper conduct of an auction, Pelienmaa may take appropriate measures to restore proper operation.
- Depending on the circumstances, Pelienmaa may extend the auction, cancel the auction or restart it.
- Such actions will be taken with due regard to users’ rights and applicable law.
13. Complaints and Dispute Resolution
- Questions, complaints or problems relating to an auction should be submitted to Pelienmaa using the contact details provided in the online store.
- Complaints will be handled in accordance with applicable law.
- Consumers retain all rights granted to them under applicable consumer protection legislation.
14. Changes to the Terms and Conditions
- Pelienmaa may amend these Terms and Conditions, in particular to reflect changes in legislation or in the functionality of the auction system.
- Changes will not affect rights already acquired by users in connection with auctions that have already ended.
- The current version of these Terms and Conditions will be published on the Pelienmaa website.
15. Applicable Law
- These auctions and the relationship between Pelienmaa and the user are governed by the laws of Finland, subject to mandatory consumer protection provisions.
- If the user is a consumer residing in another European Union Member State, this provision does not deprive the consumer of protection afforded by mandatory provisions of the law of their country of residence where such provisions apply.
